Terms of Service
Effective July 6, 2026
1. Agreement
These Terms are a binding agreement between you and Byte Optimizer LLC, the Wyoming company that builds and operates OnScanner. They cover:
- the OnScanner website, application and portal,
- the REST API and MCP server, and
- related professional services.
They include our Privacy Policy by reference. If you cannot legally bind your organization, do not use the service.
2. Accounts & Security
When you create an account, you agree to:
- provide accurate information and keep it current,
- keep your credentials safe, with a strong password and multi-factor authentication, and
- report suspicious access to support@onscanner.com.
We may suspend or terminate an account we believe is compromised or in violation of these Terms.
3. Acceptable Use & Authorization
OnScanner is a web vulnerability, security and privacy scanner. You may scan a target only if you own it, or you have explicit, documented, written authorization from the owner. We may ask for proof of authorization before scanning begins.
You must not:
- test targets you are not authorized to test,
- run denial-of-service attacks,
- misuse exploits or distribute malware,
- break applicable law, including the CFAA and GDPR,
- interfere with or reverse-engineer the service, or
- resell the service or misuse it to compete with us.
If you violate this section, we may suspend or terminate your account immediately and without refund. We may also notify law enforcement and affected parties, and take legal action, including recovery of damages and attorneys' fees.
4. Intellectual Property
Ownership is split simply:
- We own the service. The scanner, its tools, methodologies, and pre-existing IP stay our exclusive property. You get a limited license to use the service under these Terms.
- You own your data. You grant us a limited license to process it, only to deliver the service.
- You own paid deliverables. Once professional services are paid in full, the deliverables are yours. We keep the underlying methods.
We may use anonymized, aggregated data to improve the service.
5. Confidentiality
Each party will protect the other's confidential information with reasonable care. The standard exceptions apply: information that is public, already known, independently developed, rightfully received from someone else, or legally compelled to be disclosed.
These obligations survive termination for three (3) years. Trade secrets stay protected for as long as they remain trade secrets.
6. Scan Results & AI Features
Scan results are automated and informational. They describe a target at the time of the scan. False positives and false negatives are possible. Results are not a comprehensive assessment and not a guarantee of security. You are responsible for validating findings independently before acting on them.
AI features (AI Findings and AI compliance) work like this:
- They are optional, opt-in per scan, and billed in credits.
- When you enable them, your findings are sent to a third-party AI provider.
- The output is advisory only. It may be inaccurate or "hallucinated" and needs independent verification.
- AI compliance assessments are not a certification and not legal advice.

7. Disclaimers & Limitation of Liability
No assessment detects every vulnerability. The absence of findings does not mean a target is secure.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES. This includes the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and any promise of uninterrupted or error-free operation.
To the maximum extent permitted by law:
- BYTE OPTIMIZER'S TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE TOTAL FEES YOU PAID IN THE TWELVE (12) MONTHS PRECEDING THE EVENT giving rise to the claim, and
- we are not liable for indirect, incidental, special, consequential, or punitive damages.
8. Indemnification
You will indemnify Byte Optimizer against claims that arise from:
- your violation of these Terms or the law,
- unauthorized scanning through your account,
- inaccurate statements about your authorization to scan a target, or
- claims that your use infringes third-party rights.
We will give you prompt notice of any such claim and reasonable cooperation in defending it.
9. Subscriptions, Credits & Termination
Billing works like this:
- Plans renew automatically at the end of each billing cycle.
- Plans include recurring credits, subject to rollover rules.
- Credit purchases are non-refundable once applied.
- You can cancel anytime in the portal, which stops renewal at the end of the period, or by emailing support@onscanner.com.
- Mid-period refunds are discretionary, per the Refund Policy.
We may suspend or terminate the service for violations, non-payment, legal requirements, or discontinuation of the service. The sections on IP, confidentiality, disclaimers, liability, indemnification, and governing law survive termination.
10. Changes to These Terms
We may modify these Terms. For material changes, we post a revised date and give active account holders at least thirty (30) days' email notice. If you keep using the service after the effective date, you accept the new Terms.
11. Governing Law & Disputes
These Terms are governed by the laws of the State of Wyoming. If there is a dispute:
- The parties first try informal resolution for thirty (30) days via info@byteoptimizer.com.
- Unresolved disputes go to binding arbitration under the American Arbitration Association's Commercial Arbitration Rules, on an individual basis. Class actions are waived.
- Claims of IP infringement, confidentiality breach, or enforcement of the Acceptable Use section may go straight to court.
